February 5, 2022 — Exclusion Deadline
- A banquet server who worked at Liberty Warehouse sued, on behalf of herself and other similarly situated banquet service employees (“plaintiffs”), Fulton Enterprises, LLC d/b/a Liberty Warehouse, Liberty Events, LLC and Michael “Buzzy” O’Keeffe (“defendants”) claiming that defendants illegally retained and failed to distribute to service employees the gratuities paid by customers who booked banquet events.
- The Court has allowed the lawsuit to proceed as a certified class action under New York State Law. The class consists of hourly banquet service employees (including, but not limited to, job titles such as waiters, bartenders and barbacks).
- Defendants deny that plaintiffs’ claims have merit, and defendants will assert various defenses against those claims.
- The Court has not decided who is right and who is wrong. Your legal rights may be affected, and you have a choice to make now.
